TERM OF THE NHL CBA
Even though the
current CBA was not ratified until July 29, 2005, its effective date is
September 16, 2004. It is currently scheduled to expire at 12:00am
Eastern on September 15, 2011. However, the NHLPA has the right to move
this date in the following manner:
1. The NHLPA may
terminate the agreement on September 15, 2009 by giving 120 days notice,
or
2. The NHLPA may elect to extend the agreement for one additional
year [to cover the 2011-12 season] and thus make the termination date
September 15, 2012.
The NHL has no
power to terminate the deal any earlier than September 15, 2011 nor does
it have the sole power to extend this deal beyond that date. If neither
side informs the other that they wish to terminate the agreement, it
shall remain in effect from year to year. Such notification must occur
at least 120 days prior to September 15 of the year of termination.
EXAMPLES:
1.
The NHLPA may elect to terminate the agreement by giving notice to the
NHL prior to May 18, 2011 [120 days prior to September 15, 2009].
Otherwise, the agreement remains in effect until September 15, 2011.
2. If either side does not notify the other of its wish to
terminate the agreement by May 18, 2011 [within 120 days of September
15, 2011] then the CBA will be in effect for the 2011-12 League Year.
3. If the NHLPA or NHL wishes to cancel the agreement prior
to the 2012-13 League Year, it must notify the other no later than May
18, 2012 [120 days prior to September 15, 2012]. Otherwise, the CBA
